1. INTRODUCTION
This website is owned and operated by Alex Di Silvestro (“the Artist”, “we”, “our”, “us”).
These Terms & Conditions govern access to and use of this website, together with the purchase of artworks, products and services offered through it.
By accessing, browsing, using this website or placing an order, you acknowledge that you have read, understood and agree to be bound by these Terms & Conditions.
If you do not agree with any provision of these Terms & Conditions, you should not access, use or purchase from this website.
These Terms & Conditions should be read in conjunction with our Privacy Policy, Delivery & Returns Policy and any specific commission agreement or project contract where applicable.
2. INTELLECTUAL PROPERTY
All artworks, images, text, graphics, logos, visual content, designs and materials displayed on this website are protected by copyright, intellectual property and related rights laws.
Unless otherwise stated, all rights, title and interest remain the exclusive property of Alex Di Silvestro.
No content from this website may be copied, reproduced, distributed, modified, published, transmitted, stored, displayed, licensed, commercially exploited or otherwise used without prior written permission.
The purchase of an artwork transfers ownership of the physical artwork only.
All copyrights, intellectual property rights, image rights, reproduction rights, publishing rights, merchandising rights, licensing rights and commercial exploitation rights remain exclusively vested in Alex Di Silvestro unless expressly transferred in writing.
The purchaser acquires no right to reproduce, publish, distribute, commercially exploit, manufacture, license, digitise, mint as NFTs, create derivative works from, or otherwise use the artwork for commercial or promotional purposes without the Artist’s prior written consent.
3. ARTWORK REPRESENTATION
We make every reasonable effort to accurately display artworks, colours, dimensions, materials, textures, finishes and presentation details.
However, variations may occur due to screen settings, device displays, lighting conditions, photography, printing processes, material characteristics and individual perception of colour.
Artwork images are provided for illustrative and representational purposes only and should not be interpreted as exact reproductions of the physical artwork.
All dimensions, specifications and artwork descriptions are provided in good faith and to the best of our knowledge.
Handmade, hand-finished and mixed media artworks may naturally exhibit variations in texture, finish, surface characteristics, artistic application, mounting, colour perception, materials and presentation details.
Such variations form part of the originality, authenticity and intended artistic character of the artwork and shall not be considered defects, faults, misrepresentations or grounds for cancellation, refund, chargeback, dispute or claim.
By purchasing an artwork, the purchaser acknowledges and accepts the inherent characteristics of original, handmade, hand-finished and limited-edition artworks and agrees that minor variations between the artwork received and its photographic representation are normal, expected and do not affect the authenticity, value or intended function of the artwork.
4. COMMISSIONS & BESPOKE PROJECTS
The purchaser acknowledges that commissioned, bespoke and personalised artworks involve artistic interpretation, creative judgement and subjective aesthetic decisions and may not precisely replicate concepts, sketches, reference images, visualisations, mock-ups or digital previews.
Approval of any concept, proof, mock-up, visual reference, specification, design stage, progress update or production stage shall constitute acceptance of that stage of the project and authorisation for the Artist to proceed.
Following approval of any project stage, requests for substantial alterations, redesigns, revisions, modifications or changes to the agreed scope of work may result in additional charges, revised completion schedules or both.
Unless otherwise agreed in writing, any deposit paid in connection with a commission shall be non-refundable and shall compensate the Artist for time, creative services, consultation, planning, development, administration and production capacity reserved for the project.
The commissioning of a bespoke artwork constitutes a commitment to purchase the completed artwork, provided that the artwork substantially conforms to the approved concepts, specifications, references and agreed scope of work.
Where a commissioned artwork substantially conforms to the approved concepts, specifications, references and agreed scope of work, the purchaser shall remain legally responsible for payment of all outstanding balances due under the commission agreement.
Dissatisfaction based solely upon personal taste, subjective opinion, change of preference, change of circumstances, investment expectations, artistic interpretation or other matters unrelated to a material failure to comply with the agreed specification shall not constitute grounds for cancellation, refund, withholding of payment, chargeback, dispute, rejection of the artwork or non-payment.
The Artist reserves the right to suspend work, withhold delivery, retain possession of the artwork, pursue recovery of outstanding sums, recover reasonable collection costs where legally permissible and withhold transfer of ownership until all amounts due have been paid in full and cleared.
Title to, ownership of and all rights associated with the commissioned artwork shall remain vested in the Artist until full payment has been received and cleared.
Failure to pay any outstanding balance when due shall constitute a material breach of the commission agreement.
5. PRICING, AVAILABILITY & ORDER ACCEPTANCE
Artwork availability, edition availability, pricing, quotations and product information are subject to change without prior notice.
Submission of an enquiry, order request or completed checkout process does not constitute acceptance of an order or the formation of a binding contract.
All orders remain subject to review, verification, availability, payment authorisation, fraud screening and final acceptance by the Artist.
A contract for sale shall only be deemed formed once payment has been successfully received, verified and the order has been formally accepted by the Artist.
The Artist reserves the right to refuse, suspend, limit or cancel any order at any time prior to dispatch where reasonably necessary, including but not limited to circumstances involving pricing errors, stock discrepancies, edition availability issues, technical errors, payment irregularities, fraud prevention concerns, security risks or other unforeseen circumstances.
Artwork availability and edition quantities displayed on this website are provided in good faith but may occasionally be affected by simultaneous purchases, inventory discrepancies, technical issues or administrative errors.
In the event that an artwork, edition or product becomes unavailable after an order has been placed, the Artist reserves the right to cancel the order and issue an appropriate refund.
The Artist reserves the right to correct any pricing errors, product description errors, technical inaccuracies, omissions or administrative mistakes appearing on this website and shall not be obliged to honour any incorrect information resulting from such errors.
Prices may be displayed in multiple currencies for convenience only. Currency conversions are indicative and may vary from the final amount charged by the purchaser’s payment provider or financial institution.
The Artist shall not be liable for losses, costs or damages arising from pricing errors, stock discrepancies, availability issues, technical errors or order cancellations undertaken in accordance with these Terms & Conditions.
6. LIMITED EDITIONS & ONLINE PURCHASES
Selected artworks are offered as Limited Edition and Mixed Media Editions and are available for purchase directly through this website.
Each edition is produced in a strictly limited quantity as specified within the relevant artwork description. Once an edition is sold out, no additional editions will be produced unless expressly stated otherwise by the Artist.
All editions are individually signed and numbered by the Artist and may be accompanied by a Certificate of Authenticity and other supporting documentation where specified.
Edition numbers are allocated at the Artist’s discretion unless a specific edition number has been expressly agreed in writing prior to purchase.
Selected editions may include hand-finished elements, mixed media applications, artistic interventions and individual variations which form part of their intended character, originality and authenticity.
The purchaser acknowledges that all artwork descriptions, dimensions, edition information, materials, finishes, mounting specifications, framing specifications, certificates, presentation details and included components are disclosed within the relevant product listing and form part of the contractual description of the artwork.
By placing an order, the purchaser confirms that they have reviewed, understood and accepted the artwork description, dimensions, materials, presentation details and specifications in full prior to purchase.
Artwork photographs, installation images, room settings, lifestyle images and visual representations are provided for illustrative purposes only and should not be interpreted as exact reproductions of the physical artwork or as representations of actual scale within an interior environment.
Unless expressly stated otherwise, frames, furniture, interior settings, decorative objects and other staging elements shown within promotional or installation imagery are not included in the purchase.
Minor variations between individual editions, hand-finished works and mixed media artworks are inherent characteristics of the artwork and shall not constitute defects, faults, misrepresentations or grounds for cancellation, refund, chargeback, dispute or claim.
The purchaser acknowledges that handmade, hand-finished and limited-edition artworks may differ in certain details from photographic representations and that such differences do not affect the authenticity, provenance, artistic integrity, collectibility or intended function of the artwork.
Certificates of Authenticity, presentation materials, inspiration sheets, supporting documentation and ancillary materials may vary in format, design, layout, production method or presentation from examples shown on this website and such variations shall not constitute defects or grounds for dispute.
The Artist reserves the right to make reasonable modifications to packaging, presentation materials, certificates, mounting methods or ancillary components provided that such modifications do not materially alter the artwork itself.
No statement, image, marketing material, social media content, interview, article, promotional communication or third-party commentary shall be interpreted as creating any warranty, guarantee of future value, investment performance, appreciation potential or resale outcome in relation to any artwork.
The Artist reserves the right to retain artist proofs, archive copies, exhibition copies and documentation copies unless expressly stated otherwise.
No artwork, edition, limited edition, mixed media work, certificate, statement, publication, interview, website content, social media content or promotional material shall be interpreted as providing investment advice, financial advice, guarantees of appreciation, guarantees of future value, resale value, profitability or investment performance.
7. PAYMENT, VERIFICATION & FRAUD PREVENTION
All payments must be made using the payment methods provided through this website.
Orders shall not be processed, prepared, dispatched or released until payment has been successfully received, authorised, cleared and verified.
The Artist reserves the right to request additional information, documentation or identity verification before accepting, processing or dispatching any order where fraud prevention, security screening, payment verification procedures or reasonable commercial concerns require such verification.
Such verification may include, without limitation, confirmation of billing details, proof of identity, proof of address, payment card verification, purchaser confirmation or other information reasonably required to validate the transaction.
The Artist reserves the right to delay, suspend, refuse, investigate or cancel any order where payment irregularities, billing discrepancies, verification failures, unusual purchasing patterns, suspected fraudulent activity, suspected chargeback abuse, false information, unauthorised transactions, suspicious behaviour or other security concerns are identified.
Orders identified as high-risk by payment processors, fraud prevention systems, financial institutions, shipping providers or internal review processes may be cancelled without liability.
The Artist shall have no obligation to fulfil any order until all requested verification procedures have been completed to the Artist’s reasonable satisfaction.
Where an order is cancelled due to fraud concerns, payment verification failures, suspected misuse, inaccurate information or other security-related reasons, the Artist reserves the right to withhold dispatch and issue a refund only after any applicable payment verification, fraud review or security procedures have been completed.
The Artist reserves the right to refuse future orders from any customer where previous transactions have resulted in payment disputes, chargebacks, fraudulent claims, abusive conduct, repeated delivery issues or other commercially unreasonable behaviour.
Any attempt to obtain goods, services or refunds through fraudulent means, false representations, misuse of payment systems or abuse of chargeback procedures may be reported to the relevant payment processor, financial institution, courier service, fraud prevention agency and, where appropriate, law enforcement authorities.
The Artist reserves the right to retain all transaction records, communications, delivery evidence, verification documents and supporting materials for the purpose of defending disputes, chargebacks, claims and legal proceedings.
8. COPYRIGHT & REPRODUCTION RIGHTS
Ownership of a purchased artwork transfers ownership of the physical artwork only.
All copyrights, image rights, intellectual property rights, reproduction rights, publishing rights, licensing rights, merchandising rights, digital rights, commercial rights and all other associated rights remain exclusively vested in Alex Di Silvestro unless expressly transferred in writing.
The purchase of an artwork does not grant any licence, permission or right to reproduce, publish, distribute, display for commercial purposes, commercially exploit, digitise, scan, modify, adapt, create derivative works from, manufacture products from, license, mint as NFTs, use for artificial intelligence training, use in advertising, marketing, promotional materials or otherwise use the artwork in either physical or digital form without the prior written consent of the Artist.
The display of an artwork within a private residence, business premises, hospitality venue, commercial property, public space or other environment does not transfer any copyright, licensing, reproduction or commercial usage rights.
No artwork, image or derivative representation of an artwork may be reproduced, copied, photographed for commercial purposes, published, licensed, sold, distributed or otherwise exploited without the prior written consent of the Artist.
The Artist expressly reserves all rights not specifically granted in writing.
No artwork, image or associated content may be used for machine learning, artificial intelligence training, dataset creation or similar automated technologies without the prior written consent of the Artist.
9. FRAUD PREVENTION, ORDER SCREENING & COMMERCIAL PROTECTION
The Artist reserves the right to refuse, suspend, delay, investigate, restrict or cancel any order where fraud, misuse, abusive conduct, suspicious activity, attempted chargeback abuse, payment irregularities, false claims, inaccurate information or other circumstances reasonably indicate elevated commercial, financial or security risk.
The Artist reserves the right to request additional information, documentation, proof of identity, proof of address, payment verification or any other information reasonably required to verify the legitimacy of a transaction prior to dispatch.
Orders may be subject to manual review, fraud screening procedures, payment verification checks, address verification procedures and other commercially reasonable security measures.
The Artist shall have no obligation to process, dispatch or fulfil any order until all requested verification procedures have been completed to the Artist’s reasonable satisfaction.
The Artist reserves the right to refuse or cancel orders where billing information, shipping information, identity information or payment information cannot be satisfactorily verified.
Orders identified as high-risk by payment processors, financial institutions, fraud prevention systems, courier providers or internal review procedures may be refused or cancelled without liability.
The Artist reserves the right to refuse future orders from any individual, organisation or entity where previous transactions have resulted in payment disputes, chargebacks, fraudulent claims, abusive conduct, repeated delivery issues, policy abuse or other commercially unreasonable behaviour.
Any attempt to obtain artworks, services, refunds or other benefits through fraudulent means, false representations, misuse of payment systems, abuse of chargeback procedures or other dishonest conduct may be reported to payment processors, financial institutions, courier providers, fraud prevention agencies, insurers or law enforcement authorities where appropriate.
The Artist reserves the right to retain and present order records, communications, transaction data, delivery confirmations, tracking information, photographic evidence and other relevant documentation in connection with the investigation, defence or resolution of any dispute, chargeback, claim or fraudulent activity.

This website may contain links to third-party websites, services, platforms, applications, social media channels or other external resources provided solely for convenience and informational purposes.
The inclusion of any external link does not constitute endorsement, approval, recommendation or affiliation unless expressly stated otherwise.
The Artist has no control over and accepts no responsibility for the content, availability, accuracy, legality, security, products, services, policies or privacy practices of any third-party website or resource.
Accessing and using third-party websites is undertaken entirely at the user’s own risk.
The Artist shall not be liable for any loss, damage, claim, cost, expense or consequence arising directly or indirectly from the use of, reliance upon or interaction with any third-party website, service, product or resource.
11. LIMITATION OF LIABILITY
We endeavour to keep all information, content, artwork descriptions, images and materials displayed on this website accurate, current and up to date.
However, all content is provided on an “as is” and “as available” basis without any express or implied warranty, representation or guarantee regarding accuracy, completeness, availability, reliability, suitability or uninterrupted operation.
To the fullest extent permitted by applicable law, the Artist shall not be liable for any indirect, incidental, consequential, special, punitive or exemplary damages arising out of or relating to:
• The use of this website
• The inability to access or use this website
• Website interruptions or technical failures
• Third-party service providers
• Courier delays or transportation disruptions
• Customs procedures or import restrictions
• Loss of business, revenue, profits, opportunity, goodwill or anticipated savings
• Reliance upon information published on this website
• The purchase, delivery or use of any artwork or service
The Artist shall not be responsible for delays, failures or interruptions resulting from events beyond reasonable control, including but not limited to force majeure events, natural disasters, acts of government, customs actions, strikes, transportation disruptions, cyber incidents, internet outages, supplier failures or other unforeseen circumstances.
To the fullest extent permitted by applicable law, the total aggregate liability of the Artist arising from any claim, dispute, transaction or purchase shall not exceed the amount actually paid by the purchaser for the artwork or service giving rise to the claim. In no event shall the Artist be liable for any loss of profit, loss of business opportunity, loss of goodwill, loss of anticipated investment return or diminution in perceived or actual artwork value.
Nothing within these Terms & Conditions shall exclude, restrict or limit any liability or consumer rights that cannot lawfully be excluded or limited under applicable law.
12. GOVERNING LAW & JURISDICTION
These Terms & Conditions and any dispute or claim arising out of or in connection with them, their subject matter, formation, interpretation, performance or enforcement shall be governed by and construed in accordance with the laws of Spain.
Subject to any mandatory consumer protection rights that may apply under applicable law, the courts of Spain shall have exclusive jurisdiction to settle any dispute, claim or controversy arising out of or relating to these Terms & Conditions, the use of this website, any purchase, transaction, artwork or service provided by the Artist.
Nothing within these Terms & Conditions shall deprive consumers of any mandatory legal rights or protections afforded to them under applicable consumer protection legislation.
13. SEVERABILITY
If any provision of these Terms & Conditions is found to be unlawful, invalid or unenforceable, the remaining provisions shall remain in full force and effect.
