DELIVERY & RETURNS POLICY

Every artwork created by Alex Di Silvestro is individually produced, inspected, prepared and packaged with the utmost care to ensure safe delivery and long-term preservation.

Produced to high presentation and production standards using carefully selected materials and professional finishing methods, each artwork is intended to reflect the originality, character and artistic integrity of the artist’s distinctive visual language.

As many artworks are handmade, hand-finished, mixed media or released as strictly limited editions, minor variations, surface characteristics and individual details may naturally occur. These characteristics form part of the artwork’s originality, authenticity and artisanal nature and should not be considered defects.

This Delivery & Returns Policy outlines the procedures and conditions relating to shipping, delivery, customs duties, damaged deliveries, returns, refunds and Certificates of Authenticity for artworks purchased through this website.

As many artworks are accompanied by registered Certificates of Authenticity and are produced as collectible editions, purchasers are encouraged to read this policy carefully before placing an order.

By accessing this website and completing a purchase, you acknowledge that you have read, understood and accepted this Delivery & Returns Policy together with our Terms & Conditions and Privacy Policy.

 

1. CERTIFICATES OF AUTHENTICITY

Where specified, artworks are accompanied by a registered Certificate of Authenticity (“COA”) issued by the Artist.

The Certificate of Authenticity forms an integral part of the artwork’s provenance, authenticity, collectibility and market value and should be retained by the purchaser in a safe condition.

The purchaser acknowledges that the loss, alteration, destruction, transfer, damage or separation of a Certificate of Authenticity may adversely affect the artwork’s provenance, collectibility, authenticity records and resale value.

Any approved return, exchange, refund request, warranty claim or other claim relating to an artwork must include the original Certificate of Authenticity together with all accompanying documentation, presentation materials and items supplied with the artwork.

The Artist reserves the right to refuse, reduce or withhold any refund, replacement, exchange or other remedy where a Certificate of Authenticity or accompanying documentation is missing, damaged, altered, incomplete, defaced, transferred, duplicated or otherwise compromised.

The Artist shall have no obligation to replace lost, destroyed, damaged or altered Certificates of Authenticity and reserves the right to determine, at sole discretion, whether replacement documentation may be issued and under what conditions.

Ownership of a Certificate of Authenticity does not confer any copyright, reproduction rights, licensing rights, intellectual property rights or commercial usage rights in relation to the artwork.

A returned artwork without its original Certificate of Authenticity may be deemed materially incomplete.

 

2. SHIPPING & DELIVERY

Artworks are professionally packaged and dispatched from Spain using trusted tracked courier services selected at the Artist’s discretion.

Estimated dispatch and delivery times are provided for guidance only and shall not constitute guaranteed delivery dates.

Delays caused by customs authorities, courier companies, transportation providers, weather conditions, strikes, public holidays, border inspections, security procedures, force majeure events or other circumstances beyond the Artist’s reasonable control shall not constitute grounds for cancellation, refund, compensation, chargeback or dispute.

The purchaser is solely responsible for providing accurate, complete and deliverable shipping information at the time of purchase.

The Artist shall not be responsible for delays, failed deliveries, returned shipments, additional costs, losses or other consequences arising from incorrect, incomplete or outdated delivery information supplied by the purchaser.

Delivery shall be deemed completed when the courier records successful delivery to the delivery address provided by the purchaser or to any alternative delivery arrangement, collection point, secure location, neighbour, concierge, reception desk or authorised recipient accepted by the courier and authorised directly or indirectly by the purchaser.

Courier tracking records, delivery scans, delivery photographs, GPS confirmations, electronic delivery confirmations, signature records and courier documentation may be relied upon as conclusive evidence of successful delivery.

Risk of loss, theft, damage or deterioration transfers to the purchaser upon confirmed delivery by the courier.

The Artist shall not be liable for theft, loss, damage, misplacement or unauthorised access occurring after successful delivery has been recorded by the courier.

Where a shipment is returned due to failed delivery attempts, refusal of delivery, non-collection, incorrect delivery information, unpaid customs charges or other circumstances attributable to the purchaser, the Artist reserves the right to charge any additional shipping, storage, handling, return shipping, customs, administrative and processing costs incurred prior to any re-dispatch or refund.

The Artist reserves the right to delay dispatch where payment verification, fraud prevention procedures, security reviews or other reasonable commercial checks remain incomplete.

Title to the physical artwork shall pass to the purchaser upon full payment and successful delivery.

 

3. CUSTOMS, DUTIES & IMPORT TAXES

International customers are solely responsible for determining, understanding and complying with all customs requirements, import regulations, duties, VAT, sales taxes, brokerage fees and other charges imposed by the destination country.

Such charges are determined by local authorities and are entirely separate from the purchase price and shipping charges paid to the Artist unless expressly stated otherwise.

Refusal to pay customs duties, import taxes, brokerage fees or other mandatory charges shall not constitute grounds for cancellation, refund, chargeback, dispute, claim or rejection of the transaction.

Refusal to accept delivery, abandonment of a shipment, failure to respond to customs authorities, failure to provide required import documentation or failure to comply with local import regulations shall be deemed the responsibility of the purchaser.

Any shipment refused, abandoned, returned, delayed, seized, destroyed or otherwise affected due to customs-related issues, unpaid charges or import compliance failures shall not be considered a fault of the Artist, the artwork or the delivery service.

The Artist shall have no obligation to issue a refund in such circumstances.

At the Artist’s sole discretion, a goodwill refund may be considered only after the artwork has been successfully returned, received and inspected in its original condition.

Any such refund may be reduced by all shipping costs, return shipping costs, customs charges, brokerage fees, storage fees, handling costs, payment processing fees, administrative expenses, insurance costs and any other losses or expenses incurred in connection with the transaction.

Where a shipment is destroyed, abandoned, seized, lost or otherwise rendered unrecoverable due to customs-related issues attributable to the purchaser, no refund shall be due.

The purchaser acknowledges that customs duties, VAT, import taxes and related charges are imposed by third-party authorities and are outside the control of the Artist. The existence of such charges shall not constitute grounds for alleging that an artwork was not as described, not received, defective or otherwise unsuitable.

 

4. DAMAGED DELIVERIES

The purchaser is responsible for inspecting the shipment and artwork promptly upon delivery.

Any visible damage to the packaging or artwork, or any alleged delivery-related issue, must be reported in writing within 48 hours of delivery.

Claims submitted after this period may be difficult or impossible to investigate and may therefore be refused.

All damage claims must be accompanied by clear and comprehensive photographic evidence showing:

• The external packaging
• The internal packaging
• Shipping labels and tracking information
• Protective packing materials
• The artwork itself
• All visible damage alleged

The purchaser shall retain the artwork, all packaging materials, shipping labels, protective materials and accompanying documentation pending investigation of the claim.

Failure to retain such materials, provide sufficient evidence or cooperate with a reasonable investigation may affect or invalidate the claim.

No repair, alteration, disposal, return or third-party assessment of the artwork should be undertaken without the prior written consent of the Artist.

The Artist reserves the right to request additional information, photographs, documentation or evidence reasonably required to investigate the claim.

Any remedy, replacement, repair, compensation or refund shall be subject to verification of the claim and, where applicable, acceptance by the relevant courier, insurer or other responsible third party.

Minor imperfections, variations, characteristics inherent to handmade or hand-finished artworks, or matters already disclosed within the artwork description shall not constitute shipping damage.

The Artist reserves the right to determine the most appropriate remedy, including repair, replacement, partial compensation or refund, where a claim is accepted.

 

5. RETURNS & REFUNDS

Returns and refunds are subject to applicable consumer protection laws and the specific provisions set out within these Terms & Conditions.

Returns shall not be accepted solely on the basis of personal preference, change of mind, subjective artistic opinion, investment expectations, minor colour variation, screen display differences, natural material characteristics, disclosed hand-finished variations, or other characteristics inherent to original, handmade, mixed media or limited-edition artworks.

Any request for return, cancellation or refund must be submitted in writing within 14 days of delivery and must clearly identify the order, artwork and reason for the request.

No return shall be accepted without the prior written authorisation of the Artist and compliance with any return instructions provided.

Returned artworks must be received in their original condition and include all accompanying Certificates of Authenticity, documentation, presentation materials, complementary items, packaging components and any other materials originally supplied.

Returned artworks must be shipped using a reputable private courier service providing full tracking and appropriate insurance coverage for the full value of the artwork.

Unless otherwise required by applicable law or agreed in writing by the Artist, the purchaser shall be responsible for all return shipping costs, insurance costs, customs duties, import taxes, brokerage fees, handling costs and any other charges associated with the return shipment.

The purchaser remains responsible for the artwork until it has been safely received and inspected by the Artist.

Where a returned shipment is lost, damaged, delayed, abandoned, seized, destroyed or otherwise fails to reach the Artist, the purchaser shall remain responsible for any resulting loss unless such loss is demonstrably attributable to the Artist.

The Artist reserves the right to inspect and verify the condition, authenticity, completeness and provenance of any returned artwork before approving any refund.

Refunds may be refused, reduced or adjusted where the artwork, Certificate of Authenticity, documentation, packaging or accompanying materials are missing, altered, damaged, incomplete, substituted, tampered with or returned in a condition different from that in which they were supplied.

Any reduction in value resulting from handling beyond what is reasonably necessary to inspect the artwork may result in a corresponding reduction of any refund where permitted by applicable law.

No refund shall become due until the returned artwork has been received, inspected and accepted by the Artist.

The Artist reserves the right to determine the appropriate remedy where a valid claim is established, including repair, replacement, partial refund or full refund, as reasonably appropriate in the circumstances.
